AGREEMENT
AGREEMENT OVERVIEW: In the following conditions of contract Marta Rocci Photography shall mean Marta Rocci and any photographer appointed by her to work for the photography session or event. The ‘client’ shall be those whose names appear on the contract. If the clients arrange for a third party to meet the cost of this contract the contract remains with the clients. The due performance of the contract is subject to the conditions below and cannot be varied in any way by the clients unless expressly agreed by Marta Rocci Photography in writing.
COOPERATION: Unless otherwise noted, Marta Rocci Photography, it's associates or employees will be the exclusive photographer(s) at the agreed event. The clients agree that good faith cooperation and communication between them is important in obtaining a good result. Clients must also notify Marta Rocci Photography and photographer(s) in writing if they wish to have anything photographed in a particular way. Marta Rocci Photography or the photographer(s) will not be held accountable for not photographing desired portraits, if there is no one to assist in identifying these particular details and photographs on the day. Marta Rocci Photography is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to Marta Rocci Photography or beyond the photographer(s) control.
HOUSE RULES: clients agree and understand that Marta Rocci Photography is limited by the guidelines of the location site/venue management/government rules and clients agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for moderation of guidelines is solely the clients responsibility. If client appears under the influence of alcohol or drugs during the shoot, Marta Rocci Photography has the right to cancel the shoot immediately due to public liability and health and safety concerns.
Note the photographer is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location. In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the bride and groom to make themselves aware of the rules of the venue concerned and if necessary, negotiate with the personnel concerned.
IMAGES and COPYRIGHTS: Photographs/images produced by Marta Rocci Photography are protected by Copyright and remain the property of Marta Rocci Photography. Upon final payment by clients, clients are allowed to display resulting images for personal use only. Said images may not be digitally altered in any manner without prior written permission of Marta Rocci Photography. Clients will receive a high resolution digital images with printing rights. When publishing the photos on social media, Marta Rocci Photography must be credited as the photographer. The client must not benefit commercially from the reproduction of these photographs in any form. Marta Rocci Photography will choose the best images from your session/ event. The client does not take part in the process of choosing which images will be selected for the final gallery. Every images that is chosen will be fully edited to Marta Rocci Photography’s high standard.
MODEL RELEASE. Marta Rocci Photography reserves the right to publish photographs of the clients or in which the clients may be included, for editorial, trade, advertising or any other commercial purpose. The clients hereby release Marta Rocci Photography and all associates, representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to Marta Rocci Photography’s use of said images.
RETAINER & PAYMENT SCHEDULE: A non refundable agreed booking fee is due on receipt of booking form and invoice. The relevant balance for the session is due on the day of the event. If extras are added on the day of the event, payments must be paid before the images are handed over to clients.
Journeys which require more than 50 miles of travel from Edinburgh will incur travel expenses at Marta Rocci Photography’s discretion. Overnight accommodation may be required and charged for sessions that require specific timing or travel distance.
The client will provide a meal for photographers during the wedding day.
CANCELLATIONS: In the highly unlikely event of cancellation due to injury, extreme illness, or an unavoidable total photographic failure that prevents Marta Rocci Photography from photographing the event, Marta Rocci’s liability shall be limited to a full refund of any booking fee or fees paid. Reshoots may be arranged if practicable but Marta Rocci Photography will not be responsible for any further costs. Marta Rocci Photography will endeavour to appoint another photographer to attend a booking however it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.
If the client should have to cancel a booking the following cancellation fees will become due immediately:
- The clients are entitled to a full refund of the booking fee if they withdraw within 14 days of the date of the payment invoice.
- The booking fee will be forfeited on cancellations made after 14 days. Cancellations made within 2 weeks of the event incur the full cost of the photographic service booked.
- Where Marta Rocci Photography is able to rebook the date with an equivalent booking the cancellation fee will be reduced to the non refundable booking fee only and any additional cancellation fees already paid will be refunded accordingly.
- In the event of postponement, then at the discretion of Marta Rocci Photography, and subject to availability, monies from the original booking may be transferred to the new session booking.
- It is essential to inform Marta Rocci Photography as soon as possible of any changes of venue, times, or contact details etc.
LIMIT OF LIABILITY: Marta Rocci Photography takes the upmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Marta Rocci Photography's control. The client agrees that Marta Rocci Photography or the photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event.
COVID -19: Marta Rocci Photography takes the most care and social distance from the clients during the session and asking the client to the same. The client must inform Marta Rocci Photography if they are unwell or if there is any risk of being infected. Marta Rocci Photography have a right to cancel the session if there is any risk of infection and Marta Rocci’s or any other photographer appointed liability shall be limited to a full refund of any booking fee or fees paid. By signing this agreement, I acknowledge the I understand the contagious nature of COVID-19 and voluntarily assume the risk that myself to my family members may be exposed to or infected by COVID-19 and on behalf of my family members, I hereby release, covenant not to sue, discharge, and hold harmless Marta Rocci Photography or any appointed photographers of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims whether a COVID-19 infection occurs before, during, or after participation in the session.
COMPLETION SCHEDULE: DELIVERY OF USB:
Proof Printing and photo USB are normally ready within 45 working days (9 weeks) of the wedding. All through Marta Rocci Photography always keeps to this schedule, reserve the right to extend this period due to unexpected circumstances. Marta Rocci Photography will only take responsibility for print orders made from her. She will not take any responsibility for the quality of the print made by third parties.
ADDITIONAL ALBUM INFORMATION
If you choose the package with an album, you've got 1 year from the date of releasing the photos to you by Marta Rocci Photography to pick the number of photos for your chosen album, as well as download the photos from the gallery. Clients need to check the proof of album thoroughly and send an email to Marta Rocci Photography about any changes and confirmation of the layout, writings and placement of all the additional items on the cover. After the album is approved by client, they cannot make any changes to it. All changes made after approving the album or after delivering the album to the client are subject to additional charges.

I agree that the photographer can use my photographs for advertising purposes.
The photographer makes the final edit, not every shot taken will make the cut.
While I endeavour to take every shot requested this is not always possible but will be a tempted to the best of the ability of the photographer.
